Items of Business for Discussion

First Order of Business - Updated Waiver for Renewal of Insurance Submission

BOD reviewed the need for the updated standard Waiver required for submission to Wright-Gardner Insurance. A more detailed section for disclosure was discussed and a copy of amendments to the Waiver for 2006 will be given to Angela Souders (liaison to our insurance agent) to submit after approval by BOD. As per last year, a copy of current Waiver will need to be submitted for the insurance company for their records as a part of the contractual requirement with CG, Wright-Gardner and the City of Hagerstown.

Angela Souders conveyed to the BOD that, in a recent discussion with Mr. Rodney Powers, he said late March would be an acceptable time to begin the renewal process.

 

Second Order of Business - Reviewed Information from Wright-Gardner about Risk & Liability

Discussion was made regarding members in CG with health issues. They could possibly be required to wear either protective armor or, in the extreme case, be taken off the field for their safety and health, and to minimize the insurance risk and liability to the Corporation. Mr. Powers, agent for Wright-Gardner, explained in depth with regard to this that we are a Corporation. As such, the BOD's decision is a legally binding decision in matters of this sort. Furthermore, based on the information we presented him, he feels we are morally justified in restricting any member(s) in question. This policy is in keeping with normal business practices.

The BOD discussed a member who's facing brain biopsy and asked if, afterwards, he could take the field again if he wore protective head gear. Another discussion occured regarding a secondary member with a medical condition that needed clarification.

A.) When any waiver to fight on the field is filled out, disclosure of any relevant health conditions should be revealed. Not disclosing any such condition is a breach of contract with Amtgard of Maryland, Inc. As a Corporation, refusal to divulge information that could place the business at risk and/or liability gives us the right to dis-establish membership.

B.) The matter of discrimination is not a factor. Non-disclosure supercedes our responsibility to uphold that stipulation. If the person in question doesn't keep their part of the agreement, we aren't legally bound to accept their membership.

C.) Any medical condition is, without a doubt, of significant concern. Mr. Powers was adamant we should insist severe conditions never play on our field, despite any porotective armor. The liability we would accept in blindly doing so could be devastating. As a representative of Wright-Gardner, and our personal agent, he has personally stressed the assumed liability we are subjecting ourselves to in this matter.

D.) Our BOD's decisions are a mandate. As long as we keep records to validate our decisions, we are legally safe from recourse.

A motion was made to request a doctor's note that verifies with or without any protective armor, the member is undoubtedly safe and totally risk-free. This note would then need to be verified by the current Prime Minister within two weeks before the person in question could take the field.

A vote was taken - 9 Yes, 1 Abstain (Approved)

 

Third Order of Business - Changes to Corpora Requested by BL

Mark Mascaro discussed the changes requested by the Burning Lands for the Kingdom submission packet. He reviewed the history of submission for Kingdom to clarify why more changes were necessary. Below are the proposed changes to the Corpora for CG that will be brought before the next Allthing.

1.111 Exception- A Crown tourney may be held. The winner of this tourney will become the Monarch for six months or if elections are held, Champion.

1.41 The Champion is the individual who placed second in the Crown tourney.
1.411 Exception- if the Monarch is elected, then the winner of the Crown tournament shall be the Champion.

1.46 Will become the pro-tem Monarch if the present Monarch should prematurely leave the throne.
1.461 Exception- if the Monarch is elected, then the Royal Consort replaces a departed Monarch.

1.29 No Royal Consort may have the position for more than two consecutive terms.
1.2A Will become pro-tem Monarch if the Monarch abdicates or is removed from office.
1.2B The Regant must be at least 18 years of age.

1.3B No Prime Minister may have the position for more than one consecutive term.

1.41 The Champion is the individual elected to the position during crown elections.
1.49 No Champion may have the position for more than two consecutive terms.
1.4A Must be at least 18 years of age.

A minimum of five group members shall be chosen by open ballot to serve in this capacity.
7.58 Monarchs of Sub groups under the Kingdom of Crystal Groves or a designated representative may attend and have one vote in kingdom BOD meetings on issues pertaining to the whole kingdom.

179. Guildmaster of Reeves of subgroups of the Kingdom of Crystal Groves are required to pass the kingdom GMR Reeves test.

3.121 Dues paid members with 50 % attendance over the last six months of subgroups of the Kingdom of Crystal Groves may vote in any issue that affects the whole kingdom.

3.26 Dues paid members with 50 % attendance over the last six months of sub groups under the Kingdom of Crystal Groves have one vote each in kingdom monarchy position elections.

3.55 General Members are non-dues paying members. They have access to all weekly activities in the Kingdom of Crystal Groves with the exception of not being allowed to vote in elections, vote on group operational decisions, and holding group office.

3.56 Dues Paid Members have all the rights above plus they may vote in group elections, vote in group decisions, and run for Board of Directors and monarchy positions within the group. Also dues paying members are entitled to a copy of the rules, the Corpora, and the group newsletter. However, note that the group is not obligated to provide materials to a member if the cost to reproduce those materials exceeds the sum of the dues that particular person paid.

6.131 Only dues paid members with 50% attendance over the last 6 months of Crystal Groves proper may run for kingdom monarchy positions.

6.2 The Month of Crown:
Date: third weekend of the month, once every six months in June and December

B. A group may become a barony after achieving all these criteria:
2. A group consisting of at least 20 waivered players in attendance per month over the last 6 months.

C. A group may become a duchy after achieving all these criteria:
A group consisting of at least 40 waivered players in attendance per month over the last 6 months.

D. A group may become a kingdom after achieving all these criteria:
2. A group consisting of at least 75 waivered players in attendance per month over the last 12 months.

Fourth Order of Business - Taxation Amendment for Insurance of Sponsored Sub-Groups

BOD discussed an amendment to include mention of no taxation of sub-groups to Kingdom unless they request to be brought under the insurance coverage for Amtgard of Maryland (CG). It is understood that each sponsored group will have the right to send a representative to any Kingdom Allthings and have a vote in Kingdom matters. Furthermore, that anyone who pays dues within their own group shall have the right to vote in CG elections for King/Queen. (It is also understood that Nominees for Crown must still be from CG Proper).

Per that discussion, Mark Mascaro (Garth) prepared the following amendment to be considered at the Allthing:


3.57 Taxation of subgroups to support the Amtgard of Maryland, Inc General liability insurance policy.
3.571 Participation in the general liability insurance policy is on a voluntary bases to be decided by the individual subgroups.
3.572 Participating groups may be taxed to support there involvement in the group liability insurance policy at a rate in proportion
to their numbers of monthly attendance.
3.573 Participation will be from the beginning of the policy year till the next
policy year, and subgroups may not withdraw from the policy until the end
of the policy year.

Fifth Order of Business - Apendix - Malicious Acts Clause

Currently, there is a 'Malicious Acts' clause in some Kingdom Corporas which state anyone caught and/or proven guilty of any felony, etc. can be removed from the group indiscriminately. Consequently, it does not allow for a case by case basis. It also does not allow for a local interpretation of Federal and State Law Compliance. (eg, some states may require a background check and others may not) In order to comply with all State, Federal & Local laws as endorsed by the Burning Lands, the CG BOD took a vote to remove this clause and abide by any State, Federal or Local obligations as those laws permit or prohibit.

Sixth Order of Business - Election of New BOD Officers

Because Jerry Virtz (Wave) was not present due to impotant family obligations outside of town, he was called on the phone to inquire if he was interested in any available position before we discussed elections. He was not interested in doing so. We said that if his vote was needed in the case of a close vote, he would again be called.

Two people were interested in the VP position - Alex Chitwood (Xolan) and Patsy Humphrey (Draconis).
A vote was taken - Alex Chitwood (Xolan) was elected by BOD as the Vice President.

Angela Souders (Lady Angela) was nominated by several for the position of Secretary.
She accepted the nomination.
No others were intersted in that position.
A vote was taken - Angela Souders (Lady Angela) was elected by BOD as the Secretary.

Seventh Order of Business - Treasury Report

Currently, there is $1,777.90 in the bank and $240.09 in Petty Cash.
($500.00 is in reserve for Insurance Renewal)
Cooks Guild representatives Maerie Murphy (Cira) and Patsy Humphrey (Draconis) requested $150.00 for cooking supplies and $1200.00 for Feast Cost.
Kid-O-Crat Angela Souders (Lady Angela) requested nominal amount of possibly $50.00 in supplies for kids for year of 2006. She will get an inventory of what she needs and submit this to the Board for consideration for the Feast of Fools budget amount.

Eighth Order of Business - BOD Meeting Schedule

The Board of Directors discussed holding the BOD meeting on the first (1st) Sunday of each month beginning between the hours of 4 to 6 PM. The locations of these meetings will be determined month to month, but suggestions were made to utilize restaurants or neutral areas instead of people's homes.
